License hereby is limited and consists of one-time, non-exclusive United States print reproduction right only (no e-rights granted) to the original medical illustrations. License is granted upon receipt of payment in full, and shall expire at the end of print run or license term indicated above. Ownership of original artwork, copyright, and all rights not specifically transferred herein remain the exclusive property of the Carrico and Shavell - Medical Imagery. Additional license(s) are required for ancillary usage(s) at additional fees. All images are protected by copyright law and may not be used in any way without prior permission in writing and payment in full for each such use. Transparencies, digital files and/or any other media used for the reproduction of illustration(s) licensed in this Agreement with Publishing Co., Inc. shall not be sold, transferred or shared with any other party (licensee, web site, affiliate or other) without the express prior written permission of the Illustrator. Digital file, provided for reproduction purposes, shall be destroyed by licensee after use and shall not be stored or archived by licensee. (Storage for publishers' records in context of cover design permitted and shall be accompanied by illustrator © information). Alterations/derivations of the image(s) herein licensed, except for additions of typography, are not permitted. Tear-sheets of printed version are required, and shall be provided within 30 (thirty) days of publication. Credit byline, placed adjacent to the illustration(s), shall read: Medical Imagery. This License Agreement is subject to the terms pursuant to Article 2 of the Uniform Commercial Code, the United States Copyright Laws, and all applicable international treaties and conventions. In the event that Client infringes the terms of this Agreement, Client will be notified and invoiced a minimum of five (5) times the fee(s) quoted above for each unauthorized use, plus attorneys' fees and costs, and/or prosecuted for copyright infringement in U.S. Federal Court. This Agreement shall be binding upon the undersigned, their heirs, successors, assigns and personal representatives. Any dispute concerning this Agreement shall be governed according to the laws of the State of Illinois. The signature of both parties shall evidence acceptance of these terms.
